Labor Arbitration RULES The Labor Arbitration Rules (Including Expedited Labor Arbitration Rules) were revised, effective May 1, 2004, as follows: The following paragraph has been removed from the Administrative Fee Schedule: " Parties on cases held in abeyance for one year by agreement, will be assessed an annual abeyance fee of $300. If a party refuses to pay the assessed fee, the other party or parties may pay the entire fee on behalf of all parties, otherwise the matter will be closed." Explanatory note: Abeyance Fee Eliminated In December 2002, the American Arbitration Association's Labor Arbitration Rules were amended to include an annual abeyance fee of $300 for cases held in abeyance for one year by agreement of the parties. After the one-year abeyance period had expired, parties were expected to pay this fee in order to keep their file in abeyance. Absent payment, the AAA case file would be administratively closed. During the past year, we heard concerns about this fee from users of our services. These concerns were reviewed and evaluated by the Association and as a result, we have decided to eliminate the abeyance fee for all labor cases retroactive to January 1, 2004. |
