CONSTRUCTION

For over 40 years the American Arbitration Association® (AAA) has set the standard for alternative dispute resolution (ADR) rules and procedures in the construction industry. As the provider of choice for dispute avoidance, conflict management and dispute resolution services, the AAA® has worked closely with the construction industry to develop ways to prevent and manage conflict.

Industry Rules & Dispute Avoidance Services


The AAA collaborates with the more than 25 industry associations that make up the
National Construction Dispute Resolution Committee (NCDRC) to develop industry-specific dispute resolution procedures and processes. AAA procedures are designated in standard form industry contracts, including those of the American Institute of Architects (AIA) and ConsensusDOCS.

The AAA has developed resources and provides value-added services to assist construction industry professionals in selecting appropriate dispute avoidance and resolution processes. In conjunction with these services, the AAA maintains a National Roster of Neutrals that have a broad range of industry and construction law expertise which they use in the dispute resolution process.

Case Management Services, Information and Guides:


EFFECTIVE JUNE 1, 2010:
The AAA will retain a portion of the administrative filing fee if a party files a demand for arbitration that is incomplete or otherwise does not meet the filing requirements contained in the Rules, and if the deficiency cannot be corrected in a reasonable period of time. Please review the fee schedule in the current rules for additional details.

Important Notice For Customers and Neutrals: Generally, the AAA Construction Rules as amended and in effect on the date of filing apply to a dispute. For cases filed before October 1, 2009, or for cases where the arbitration agreement requires the AAA Rules in effect at the time of the execution of the agreement, click here for our Archived Rules.
