Panelist Spotlight: Wendy Keane Kleine

Wendy Keane Kleine is a construction lawyer who represents owners, developers, contractors, and design professionals in all phases of the construction and dispute resolution process.

She has litigated significant construction claims from the owner, developer, contractor, and design professional perspectives, with experience in court and arbitration. She counsels clients through all phases of the construction process, including contract drafting and negotiation, bidding, contract administration, litigation and alternative dispute resolution proceedings.

She is also one of the featured panelist trainers of our AI Arbitrator. She discusses her experience with the tool.

What surprised you most when you first worked with the AI Arbitrator?

The ability to streamline voluminous exhibits into useful chronologies.

Where did your judgment matter most in shaping or refining the outcome? 

AI Arbitrator is not replacing a human arbitrator’s judgment, but rather assisting human arbitrators in reaching decisions in a more expeditious matter My judgment will always be exercised to ensure that I am reaching the appropriate outcome for the underlying dispute, regardless of whether AI Arbitrator is being used.   

What do you think people misunderstand most about AI-led arbitration? 

That a human arbitrator is still entirely responsible for reviewing and weighing the evidence and the law and reaching the appropriate outcome. The question is just how long it will take to reach the result – the result itself will be the same with or without AI Arbitrator. 

What role do you see AI-assisted decision-making playing in the future of arbitration and dispute resolution? 

AI will help streamline and expedite arbitrations so that decisions can be reached by human arbitrators in a more efficient manner and at a reduced cost to the parties.  AI is here to stay, and all parties involved in an arbitration (from the case administrators to the parties to the arbitrators) should be responsibly using AI if they are not already.
