New York State Insurance Arbitration Programs

The AAA administers three distinct New York State insurance arbitration programs: New York No-Fault arbitration, which resolves disputes over payment of benefits after motor vehicle accidents; SUM/UM arbitration, which resolves claims when an at-fault driver lacks sufficient insurance; and HIMP arbitration, which resolves reimbursement disputes over worker's compensation medical payments. The AAA may administer other insurance-related disputes under applicable agreements to arbitrate and AAA rules.

AAA-administered New York No-Fault cases are filed and managed through the AAA’s New York Insurance ADR Center. The ADR Center is a secure, cloud-based online platform that allows parties and panelists to negotiate settlements, check account and invoice balances, and perform other case management functions in real time. Managing a case in the ADR Center allows participants to communicate efficiently and achieve a speedy resolution.

Any party to a case (injured person, medical provider, attorney, insurance carrier, or third-party administrator) can obtain access to the ADR Center.

New York No-Fault arbitration resolves disputes over payment of benefits after motor vehicle accidents. These disputes normally focus on whether an insurer must reimburse medical bills or other covered expenses after an accident. The AAA administers No-Fault arbitration on behalf of the New York State Department of Financial Services. The purpose of this program is to provide claimants, providers, and insurers with a formal alternative dispute resolution (ADR) process to resolve unpaid or denied No-Fault claims without resorting to litigation.

To file a New York No-Fault arbitration case, you must first contact AAA’s New York State Insurance Customer Service to register for an ADR Center account, if you do not already have one. To get started, please call 917-438-1660 or email nysinsurance@adr.org.

After registration, cases are filed and managed through the AAA New York Insurance ADR Center, a secure, cloud-based case administration platform. Our Simple File platform is also available for streamlined submissions.

New York Supplementary Uninsured/Underinsured Motorist (or SUM/UM) arbitration resolves claims when an at-fault driver in a motor vehicle accident lacks adequate insurance. SUM/UM cases involve an injured driver or passenger seeking coverage from their own insurance company when the at-fault driver has no insurance or not enough insurance to cover the claim. The AAA administers SUM/UM arbitration on behalf of the New York State Department of Financial Services.

The New York Workers’ Compensation Health Insurers Match Program (HIMP) requires mandatory arbitration to resolve disputes over medical payments arising from a workplace accident or occupational illness. The AAA administers this program on behalf of the New York Workers’ Compensation Board. The program provides parties with a formal process for seeking arbitration of eligible reimbursement claims involving health insurers and health benefit plans.

The AAA provides online separate searches for New York No-Fault Insurance redacted awards and New York Supplementary Uninsured/Underinsured Motorist redacted awards. The award library helps parties, counsel, arbitrators, and the public research prior decisions and understand how similar issues have been resolved.
